Legal Roundtable - July 23-25, 2012 - Ft.Worth, Texas

It was an outstanding start for the SGA’s newest interest groups. The Legal Roundtable was a resounding success. The many hours of work by Chair, Beth Minear (NiSource), the Committee and Walter Ice (NiSource), the 17 registered attendees and a number of others heard exceptional presentations from subject matter experts and engaged in value adding discussions and exchanges of information. Beth and Walter were also able to secure CLE’s from the following states: Kentucky, Illinois, Indiana, Texas, West Virginia, North Carolina, Virginia, Pennsylvania and Colorado.

Glen Boatwright, Vice President, Nixon Associates, opened the Roundtable with a presentation which reviewed the recent pipeline and industry incidents with the purpose of preparing companies to develop comprehensive response plans to operational emergencies. Glen shared lessons learned through his work in the industry and provided recommendations regarding preparedness, management and responses to emergencies. He challenged the attendees to consider the following:

  • Are you truly prepared for an emergency?
  • Have you coordinated with emergency responders and the public sector?
  • Are you testing your emergency response procedures and plans through mock exercises?
  • Have you thought through all the possible disaster scenarios?

Anupam Razdan, Axiom Law, opened Session 1 with an Ethics presentation that highlighted the management of in-house counsel records, retention policies and shared the latest in e-discovery litigation and penalties.

Melissa Glassman and John Wilburn, Partners with McGuire Woods LLP, provided the attendees to an overview of right-of-way acquisition negotiations, managing injunctions and judicial remedies and the training of agents and field personnel.

Armando Benincasa and Kurt Krieger, both attorneys with Steptoe & Johnson PLLC, opened Session 2 which was a joint session with the Right-of-way roundtable. Armando focused his presentation on state and federal environmental and administrative considerations. He covered DEP and EPA considerations, state and federal lands and park permitting and regulatory compliance in all these areas. After he concluded with a review of responding to notices of violations and mitigation strategies, Kurt provided a midstream regulatory overview and provided insights on the development of project siting and approvals.

Rodney Bean and John Merinar, attorneys with Steptoe & Johnson, followed with an enlightening presentation on the application of the current laws related to job applications, qualifications and hiring practices. He also shared with the attendees best practices for performance evaluations, counseling and development of improvement plans. Supply chain contracts and records retention topics were also covered.

The final Session 3 was moderated by Nick Helman, South Star Central Gas Pipeline, was committed an open roundtable forum to discuss recent lawsuits impacting the industry and the implications. David Poole, Range Resources, provided an update on a number of proceedings regarding the hydraulic fracturing of wells. Air and water quality issues and proceeding were discussed and strategies and best practices shared.

The Roundtable was adjourned. It was a strong start for the Legal Roundtable and the planning will begin during the next few months for the 2013 Legal Roundtable which will be held in Houston in conjunction with the SGA Operating Conference at the Hyatt Regency in July, 2013.
